Please read the following terms and conditions of use of the Panda Games App application carefully, before using it.

Each time you use the App, you will grant your approval regarding the terms and conditions within this document.

If you do not completely agree with the provided terms and conditions, do not use the App.

We reserve the right to make changes to these CONDITIONS at any time and for any reason. We will alert you about any changes by uploading the “Last updated” date of these CONDITIONS. You are encouraged to periodically review these CONDITIONS to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised CONDITIONS by your continued use of the Application after the date such revised CONDITIONS are posted.

Each time the App starts, it checks whether a new version of Terms & Conditions is available. To continue using the App, you need to accept these new terms by checking the "I Accept Terms & Conditions" that will Popup automatically, only after that, you can resume using the App.

The Privacy Policy does not apply to any third-party's' online/mobile store from which you install the Application or make payments, including any in-game virtual items, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

In any mention regarding "the App", "We" refers to "PandaGames App.

"PandaGame App" is a platform developed by PandaBetUSA LLC. PandaBet USA LLC. is the sole owner of the app, as well as of all rights arising thereof . PandaBetUSA LLC. is a company registered in accordance with US Law, registration Address: 105 E.Reno Avenue, Suite B, Las Vegas, NV 89119.

General Provisions

PandaGame App was created as a platform to entertain its users by offering a wide selection of games. Games are grouped in 4 main Categories:

• Computer Games.
• Social Games.
• Contests PvP (Player vs Player).

A User can create an account in the PandaGame App and use various methods of payment in order to buy Panda Coins , referred as PaC.

https://www.pandagame.us is the uniform resource locator of the Website operated by PandaBetUSA LLC for that game and no unauthorized use may be made of this URL on another website or digital platform without our prior written consent.

By using the App and accepting these Terms and Conditions (The Conditions), the User agrees that these Conditions are fully opposable to him. These Conditions need to be interpreted in conjunction with the User Policy included in the Conditions, which can be periodically modified. The User has the responsibility of being aware of the App’s User Policy.

The present conditions explain the obligations of PandaGame App towards the users as well as the obligations of the users towards PandaGame App. You are not allowed to register on the Website and use our services regardless of your origin or the place you are resident in.

Registration is done EXCLUSIVELY via mobile Apps and we reserve the right to refuse customers at our own discretion.

Definitions

User is the identifiable person that owns an Id in the PandaGames App system. The user must introduce his email address and/or Mobile number in order to facilitate the re-logging to his account in case he forgets the password. The User shall use the App for the purpose and under the conditions provided in the present Conditions.

Confidential data – are the user’s identification data, as well as any other information inserted by them which will be taken over by PandaGames App only for the purpose of allowing them to use the App.

Personal data processing is defined as: any operation or set of operations, which are performed on personal data through PandaGames App, such as collecting, recording, organizing, storing, adapting or modifying, extracting, consulting, using, disclosing to third parties through transmission, dissemination or in any other manner, joining or combining, blocking, deleting or destroying.

Modification of the terms and conditions

PandaGame App reserves its rights to modify, supplement, or dissolve the present Conditions at any time, by publishing the modified Conditions in a special page that pops up in the App. Excepting the cases in which we explicitly specify otherwise, any modification of the Conditions shall be immediately enforceable.

The App will automatically take the User to a Page where he should Accept the new Terns & Conditions. The user is aware that declining the new Terms will prohibit him from using the App.

In case of a dispute between the User and PandaGames App, regarding the published version of the Conditions, PandaGame App or its owners are NOT liable.

System Commissions and Result generation

By accepting our Terms & Conditions, a user accept and acknowledge the following:

1. Accepts the sentences generated by our platform related to Host and Guest for each contest.
2. Accepts the results input by our system for all contests.
3. Accepts the system commission taken at source, by PandaBet platform for each contest result.
4. Accepts the results of the Analysis executed by our platform for all PvP (Player vs Player) games, more precisely for:
• Rock, Paper, Scissors Game
5. Accepts the system commission taken at source, by PandaBet platform for each PvP game result or session.

Use of the application

In order to use the App, it is necessary that the Users create a profile by registering using only an email and password. Once created and verified, the email check is followed by Mobile 2FA Check.

Only after a valid mobile 2FA verification, the user can edit his profile in the App and use the services.

When we close or suspend an Account for whatever reason, we reserve the right to close any future Accounts that may be registered by the same person, device, address, or that may use the same payment wallets or credit cards.

The user MUST be aware that this game, prohibits checking out with Money or any other currency, be it digital or FIAT. The only way to convert REWARDED PaC is via the Market Place page of the App.

By agreeing to these CONDITIONS the user consent that all winning declarations and prizes accorded are analyzed, decided, registered and processed exclusively by the COMPANY's' system. The user has no right, at any time,to argue or complain about any decisions and prize distribution done by the COMPANY and dispatched into the system. This statement is valid for all types of games within the PandaGame App.

Personal data

We may request access or permission to certain features from your mobile device. including your mobile device’s Bluetooth, camera, contacts, storage, and other features. If you wish to change our access or permissions. you may do so in your device’s settings.

Push Notification:

We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Use of your information:

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Application to:

• Resolve disputes and troubleshoot problems.
• Respond to product and customer service requests.
• Create and manage your account.
• Notify you of updates to the Application.
• Process payments and refunds.

We keep the personal data until you delete your account, or if you’ve made a payment as long as the law requires in order to validate the payment.

The only third parties that have access to Users’ personal data are: the online payment gateway and hosting service provider.

When you post comments, contributions or other content to the Application, your posts may be viewed by all users and may be publicly distributed outside the Application in perpetuity.

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

Sale or Bankruptcy

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy. User’s restrictions

The User is forbidden to redistribute, sublease, multiply, use the App in a way that will decompile, translate, rewrite, reconfigure, or change it, in order to try to reconfigure the App.

The User is forbidden to disclose any confidential information regarding the Services to any third party, without the previous agreement of PandaGame App.

The user is forbidden to use the App outside the recommended operation environment.

The user is not allowed to judge the results of games provided by the system, indifferent of the Game type.

User’s conduct

The User is not allowed to use the App:‍

• in a way that would prejudice the Conditions, any law or which is in any way illegal or fraudulent.
• in order to send, to receive, to upload or to download, or to use any material that has an abusive, indecent, defamatory, obscene character or which contains a threat, through the App.
• in order to send, to receive, to upload or to download, or to use any material that has no relevance to the purpose the App was created for.
• by breaching copyrights or the confidentiality of any information.

The User shall respond to every information request sent by PandaGame App with respect to the use and security of the App, in due time and as promptly as possible.

PandaGame App is not reliable for the damages done to the User, because of delayed or improper responses. The User is strictly forbidden to use the App in order to destroy or alter the content or the security of the App or in order to discredit or harm his/her partners, clients or collaborators, and their products, services and employees. The same goes for the actions taken against other Users he/she was made aware of, irrespective of the method through which he/she was made aware of the information.

Data encryption

The App, when connecting to our server, uses 2 security levels:

• Transport Layer Security: Ensured by exclusive SSL connection to the server.
• Data Layer Security: Ensures that the data transmitted over the Transport Layer is encrypted by the user’s Encryption Key which is different for each user.

Protection of PandaGames App’s intellectual property

The App, along with the brand and its content is fully created by and it is rightfully owned by the company PandaBet USA LLC , which is why it is protected by the laws applicable to copyright and intellectual property in US, in every state member of the European Union as well as by the legislation applicable in any other non-EU state.

Any illegal copying or attempt to illegally copy any element included in the App (algorithm, interface, logo, trademark and others) shall be punished according to the applicable law, both on the civil side, by granting compensation for the prejudice suffered by PandaGames App and also on the criminal side, depending on the crime committed.

Compensations

The User undertakes to compensate and to exonerate PandaBetUSA LLC of any responsibility regarding any obligations, losses, claims and expenses that might arise from the User’s failure to observe the present Conditions, as well as from the transmission or receipt of any information, requested or provided by the User, within the PandaGame App.

Limitations of liability

PandaBetUSA LLC shall not be held responsible in any way for no direct or indirect prejudices arising from the User’s loss of profit, personal data or any other type of loss, resulting from:

• the use or the impossibility to use the App, caused by circumstances that PandaBet USA LLC can’t reasonably control, including thunders, floods, extreme weather conditions, fires, explosions, wars, public disruptions, work conflicts or actions of the local or central public authorities or of other competent authorities or actions or omissions of third party service suppliers.
• the unauthorized access of third parties by damaging the User’s identification data.
• incorrect information introduced into the PandaGames App and therefore the documents generated based on the incorrect information introduced.
• the generation of legal or fiscal documents, since the User undertakes the obligations of verifying the validity of any document and information generated in the PandaGames App

PandaGames App does not monitor the content of data kept by the User and it does not guarantee that these data have no illegal content or that they don’t include other inacceptable materials.

Settlement of conflicts

If a conflict occurs between PandaBetUSA LLC App and the User, they shall try to settle it amicably.

If the conflict can’t be settled amicably, the parties shall address to an arbitrary or to the competent courts of law in the state of Nevada, US.

PandaBetUSA LLC may order the exclusion of a User from the App, if he/she identifies, or the other Users signal abuses in this respect.
